Knockout blow for Gachagua as High Court judges uphold his impeachment as Deputy President

High Court upholds Senate’s decision to impeach former Deputy President Rigathi Gachagua, ruling that the process was constitutional and lawful.

Former Deputy President Rigathi Gachagua has suffered a major legal setback after the High Court upheld his impeachment, dealing a blow to his efforts to overturn his removal from office and revive his political career.

The ruling effectively shuts the door on his immediate prospects of returning to the deputy presidency.

In a unanimous judgment delivered by a three-judge bench comprising Justices Eric Ogola, Antony Mrima and Fredah Mugambi, the court found that both Parliament and the Senate acted within the Constitution and followed the law in removing Gachagua from office.

The judges held that the impeachment met the constitutional threshold required for the ouster of a sitting deputy president.

Gachagua had challenged his October 2024 impeachment on multiple grounds, arguing that the process was unconstitutional, procedurally flawed and denied him a fair hearing.

However, the court dismissed those arguments, ruling that the impeachment proceedings complied with constitutional and legal requirements.
