Court suspends Herman Manyora’s appointment as Kenya Hospital Authority board chair

The order, issued by Justice Jairus Ngaah, follows a petition by a Nairobi-based doctor challenging the legitimacy of Manyora's appointment.

A Nairobi Court has temporarily halted the appointment of political analyst Herman Manyora as the chairperson of the Kenya Hospital Authority (KHA) board, pending the determination of a hearing on the same set for July 17.

The order, issued by Justice Jairus Ngaah, follows a petition by a Nairobi-based doctor challenging the legitimacy of Manyora's appointment.

In court documents, the complainant argues that the selection process was flawed, lacked openness and did not comply with legal and constitutional guidelines for public appointments.

The petitioner subsequently urged the court to declare Manyora's appointment unconstitutional and void, and to nullify the gazette notice that formalized his installation to the post.

Justice Ngaah certified the matter as urgent and directed the petitioner to serve the Health Cabinet Secretary, Aden Duale, Attorney General Dorcas Oduor, and Manyora within three days.

"In the meantime, a conservatory order is hereby issued suspending the appointment of Prof Herman Manyora as the Chairperson of the Board of Directors of the Kenya Hospital Authority," read part of the order issued by the court.

The judge also gave the respondents seven days to respond ahead of the scheduled hearing on July 17.

The development came just hours after KHA and the Nairobi Hospital issued an advisory warning Kenyans not to engage with Manyora in any capacity representing the organization.

In the notice, KHA maintained that Manyora's appointment was not recognised by laws governing the Association.

"His claim to the position is the result of a process that is not recognised under the constitution and laws governing the Association," the notice stated.

"He is not authorised to act on behalf of KHA/Nairobi Hospital, and the institution will not be liable for any transactions or representations made by him or his agents," read the statement.

On Friday, a faction within the Nairobi Hospital Board led by Manyora claimed he holds the legitimate leadership of KHA.

In a statement, the group said Dr Barcley Onyambu was removed as chair during a special board meeting on June 30, 2025, and that Prof Manyora was duly elected.

"Dr. Onyambu was removed from the position of Chairman, and Prof. Manyora was duly elected in his place," their statement read.

"Prof. Manyora is now fully vested with the mandate, authority, and responsibilities of the office of Chairperson of the Board and is legally entitled to discharge all functions attendant to the role.
