"We do not find any fault in the DCJ assigning judges to sit on this bench, more so when the CJ has not raised any red flag."

Kindiki was set to appear before the Senate alongside Energy and Petroleum Cabinet Secretary Opiyo Wandayi, both of whom failed to attend the session.

Gachagua had sought clarification on how DCJ Philomena Mwilu selected the three-judge panel without an order by the Chief Justice.

This turn of events, they claim, raises concerns about the integrity of the judicial process and the petitioners' ability to receive a fair hearing.

Additionally, Gachagua highlighted media reports indicating that Kapseret Member of Parliament Oscar Sudi stated that Kindiki would be sworn in as Deputy President on October 22.

At the same time, the High Court has put a temporary halt on the appointment process.

Gachagua was impeached by the Senate on Thursday night while admitted to Karen Hospital in Nairobi.

Eugene Wamalwa echoed Kalonzo's sentiments, faulting the Senate for violating the principles of natural justice.

This comes after the Senate upheld the impeachment of former Deputy President Rigathi Gachagua on Thursday night.

Muite and team had alleged that Gachagua suffered chest pains and was admitted at the Karen Hospital.

Gachagua failed to appear before the House for cross-examination, with reports indicating he had been hospitalised.

Dr. Gikonyo reaffirmed that Gachagua was being treated according to standard medical procedures.

“Is this impeachment motion really and truly your motion? I ask that question because, on all accounts, the witness is unable to prove anything," Senator Wambua wondered.

Senators are currently voting against the 11 grounds of impeachment separately, electronically.

Kingi suspended the sitting until 5 pm to allow Muite to track Gachagua who will then take to the stand.

Gachagua will be kicked out of the office before the end of this week if his legal team does not secure the conservatory orders.

If the night won’t be long for Gachagua ahead of his day of reckoning, then the one hour between the verdict and the Senate commencing the hearing at 9 am could feel like an eternity.

The cases, filed in various courts, will be consolidated under the panel's review.

Historically, presidents have fired their deputies. But the adoption of a new constitution in 2010, saw the introduction of a process for impeachment – for both the president and the deputy.

"I am now seen as a spent cartridge," Gachagua lamented.

"My response was not part of what was presented to the people of Kenya," Gachagua argued.

"It’s only fair that the 7million plus people who elected me hear directly my side of the story," he added.

Gachagua expressed his outrage over the accusations and clarified his role as the executor of his brother's estate in a late Monday press briefing.

"I have no intention to resign; I will fight to the end. How dare you suggest to me to resign?" Gachagua wondered.

Gachagua further clarified that approving government expenditures is the responsibility of Parliament, not his office.

Munyaka's decision comes amid escalating tensions between President Ruto and Deputy President Rigathi Gachagua, who is facing impeachment.

"You will be shocked. Let's wait and see (whether the impeachment happens). I hear the motion is tomorrow," Gachagua stated.

Despite these ongoing legal battles, the political momentum to oust Gachagua appears to be growing.
