DPP granted 30 days to review Mawego Police Station arson case files

Eight individuals are accused of torching the police station in Homa Bay County and are facing terrorism, arson, and malicious damage charges.

The Director of Public Prosecutions (DPP) has been granted 30 more days to review case files in the ongoing Mawego Police Station arson case.

Eight individuals are accused of torching the police station in Homa Bay County and are facing terrorism, arson, and malicious damage charges.

Kahawa Senior Principal Magistrate Richard Koech allowed the request by the DPP during a mention of the case.

He directed the case to be mentioned on September 29, 2025.

The accused are Kennedy Oluoch, Nicholus Otieno, Tofiq Owiti Mohammed, Michael Omondi Opiyo, David Bill Clinton Otieno, Samuel Ouma, Robert Ouko Abala, and Erick Obunga Osumba.

They face three charges: committing a terrorist act contrary to section 4(1) of the Prevention of Terrorism Act, arson under section 332 of the Penal Code, and malicious damage to property under section 339 of the Penal Code.

The eight suspects had initially denied all charges when they were arraigned on July 15, 2025. At that point, seven of them were granted release on a cash bail of Sh50,000 each, while Abala remained in custody.

However, in the latest mention, Magistrate Koech revised Abala's bail terms, allowing him to be released on the same bond terms as his co-accused.

The magistrate also directed that the accused persons may attend future sessions virtually if they so wish.

The prosecution told the court that more time was required to review case files and assess the evaluation report into the incident, which saw the Mawego Police Station reduced to rubble.

The case has attracted significant public interest as the accused face charges linked to terrorism, a capital offence under Kenyan law.
