Kitui MCA Cyrus Musyoka, alias "Wa Mathina" arrested again over suspected theft

Criminal records show that Wa Mathina had been charged several times at the Makadara law courts, Nairobi, and a warrant of arrest had been issued before he was elected in the August 2022 General Election.
Kitui Member of County Assembly Cyrus Kisavi Musyoka alias Daniel Mulei wa Mathina was arrested on Tuesday this week in connection with the theft of Sh1.9 million phone accessories at Buscar Courier Services offices in River Road, Nairobi.
He was caught on CCTV footage leaving with the consignment.

The consignment belonging to a Mombasa trader had been stolen on February 8 this year, and Wa Mathina was arrested in the area after he was identified via CCTV footage.
“The arrest followed a positive identification after a CCTV footage of the scene was analysed, which recorded the suspect leaving with the parcel destined for a Buscar Courier Services client in Mombasa,” the Directorate of Criminal Investigations said in a statement.

In February this year, he was charged with forgery of motor vehicle ownership documents.
He had forged the documents while allegedly attempting to defraud the Kitui County Assembly of Sh2.2 million, which was supposed to be a reimbursement for a car he claimed to have bought as his official car after the Wiper Party promoted him to the office of Deputy Minority Whip in the Assembly.
On November 25, 2024, Principal Magistrate Irene Gichobi then of Makadara Law Courts issued a warrant of arrest after the MCA failed to appear in court to answer to different charges of theft.
Wa Mathina had been rescued from a lynch mob along Haile Sellassie Avenue by police officers from Kamukunji police station who rushed him to a hospital where he introduced himself as Wa Mathina and denied that he was Mr Musyoka.
Members of the public had accosted him months after he allegedly stole mobile phones worth Sh347,730 from Kinatwa Prestige Matatu Sacco’s offices near Afya Centre in Nairobi.
Wa Mathina was released on cash bail of Sh40, 000 which was paid by his county assembly colleagues, to continue with treatment as investigations went on before being charged, but he failed to show up in court, prompting the issuance of a warrant of arrest.
Wa Mathina had turned up at the Kinatwa Prestige offices along Tom Mboya Street and asked to amend the phone contacts of the recipient of the parcel he claimed to have had delivered there to drop off.
This parcel had been delivered to the parcels office by Robert Okware, an employee of SH Communications, who was sending the same to a client based in Matuu Township, Machakos County – identified as Hassan Abdullahi.
However, Wa Mathina went to the courier office a few minutes after Okware left, introduced himself as the sender of the parcel and requested to change the details of the recipient.
He edited the parcel’s destination and recipient’s details, including contacts and indicated himself as the recipient and shared his telephone number on the parcel.
During investigations, officers from DCI Kamukunji offices wrote to the National Registration Bureau (NRB) seeking identification details of the politician, attaching his fingerprints after he insisted his identity was Wa Mathina.
“The fingerprint impressions recorded from C24 were searched in our fingerprints bureau and a record was traced bearing identical fingerprint impressions in the details Cyrus Kisavi Musyoka as authenticated by an extract of the register attached hereto,” stated NRB’s Filbert Lilwa in a letter to DCI Kamukunji, seen by this writer.
Lilwa had attached a register showing Wa Mathina’s father as Peter Musyoka Muasya of Muiwani Clan of the Kamba Community from Kiumbisyo village in Ithumura Sub Location, Ikanga Division in Kitui South.
The ID card number that Lilwa shared with the DCI Kamukunji was the same one used to register the telephone number that Wa Mathina had used in the theft of the assorted mobile phones in the parcel.
The investigations by the Forensic Bureau at the DCI headquarters also revealed that Wa Mathina called Titus Musyoka, the driver of the matatu (KDH 148H) that left the Nairobi office with the parcel, on the same night of August 3, 2024.
Musyoka was arrested and charged alongside three colleagues – Willy Musau, Ruth Kaswii Nzomo and Stephen Mwatu Mutiso, who were on duty at the parcel office and who unknowingly allowed Wa Mathina to edit details of the parcel during the planning and meticulous execution of the theft allegedly by Wa Mathina.
They were charged with conspiring with Mathina to steal the phones, which they denied at the Makadara law courts and have been released on bail and bond terms.
