Court rules Governor Abdi Guyo impeachment is null and void

The High Court has ruled that earlier orders preventing the impeachment of Isiolo Governor Abdi Hassan Guyo remain in effect. Justice Heston Nyaga, sitting in Isiolo, further declared that the impeachment of Governor Guyo is null and void.

"The orders of June 25 were not set aside or stayed; they remain in force," the judge stated.

The court had previously issued orders restraining the County Assembly from taking any action on the impeachment motion, and these orders have not been lifted.

Justice Nyaga criticised the County Assembly for proceeding with the motion despite the existence of valid court orders staying the process.

The court further found the Assembly to be in contempt of court for wilfully disobeying a conservatory order, thereby committing judicial contempt.

Justice Nyaga emphasised the seriousness of the violation, stating that defying court orders strikes at the very core of the rule of law.

The respondent's counsel, Dr Ekuru Aukot, requested leave to appeal. However, Justice Nyaga ruled that no appeal would be considered until the respondent appeared physically before the court, reinforcing the judiciary’s stance that accountability is not optional.

Previously, the same court had issued temporary conservatory orders restraining the County Assembly and its Speaker from proceeding with the planned impeachment of Governor Guyo, pending the hearing of a petition.

Justice Nyaga held that the petitioner, Abdi Ibrahim, had presented a strong case warranting interim protection until the matter is heard and determined.

"I am satisfied that the Petitioner/Applicant has made out a case that warrants the relief sought," the judge ruled on Monday.

The court certified the application dated June 13 as urgent and directed that it be served on all respondents by close of business on Tuesday, June 17, 2025.

In the meantime, the court barred the respondents, including the County Assembly of Isiolo and its Speaker, from admitting, processing, debating, or in any way considering the Notice of Motion dated June 10, which sought to remove Governor Guyo from office through impeachment.

The motion had been scheduled for debate on Tuesday, June 17, or on any other date to be set by the Assembly.

Justice Nyaga further ordered the third respondent, whose name was not disclosed in the ruling, to provide the petitioner with a copy of the Notice of Motion and all supporting documents within 48 hours of being served with the court order.

The respondents are required to file their responses within seven days of service, while the petitioner may file and serve any supplementary affidavit within three days thereafter.
