Kenya commences extradition proceedings of British soldier accused of Agnes Wanjiru's murder

The ODPP informed the court that the extradition request has been transmitted to the Office of the Attorney General.

The Kenyan Government has formally commenced extradition proceedings against a British soldier accused of murdering Agnes Wanjiru in Nanyuki over a decade ago.

The Office of the Director of Public Prosecutions (ODPP) informed the court that the extradition request has been transmitted to the Office of the Attorney General (AG), the central authority responsible for forwarding such requests to the United Kingdom.

Appearing before Justice Alexander Muteti, a representative from the Attorney General's office confirmed that two physical copies and a soft copy of the extradition documents were dispatched on October 9, 2025, through official diplomatic channels.

The documents were acknowledged and stamped as received by UK authorities on October 13, 2025.

"The extradition process has been initiated. We have done our part and are now waiting for the Attorney General to forward the documents to the UK central authority," the court heard.

The prosecution requested that the matter be mentioned in January 2026 to confirm the status of the suspect's arrest and surrender. However, Justice Muteti rejected the proposal, directing that the matter be mentioned monthly to ensure accountability and continuous monitoring.

"This court agrees that the process should not be delayed. The DPP shall update the court regularly, at least once every month, to ensure progress," ruled Justice Muteti.

The court also cautioned all parties against litigating the case through the media and ordered that all materials shared with the victims remain confidential.

"The victims must be supplied with necessary materials, but there should be no disclosure to avoid a trial outside court," the judge emphasised.

The next mention has been scheduled for November 24, 2025.

In a previous session, Justice Muteti had issued a warrant of arrest against the British national linked to the 2012 murder of Agnes Wanjiru, whose body was discovered in a septic tank near a Nanyuki hotel where British soldiers were stationed for training.

"The court issued a warrant of arrest, and the DPP has dutifully transmitted it to the Attorney General. The process is now in the hands of the AG," the court noted.

The judge acknowledged that extradition proceedings are often lengthy and involve multiple jurisdictions, urging patience from the victim's family as the matter progresses.
