34 senators voted in favour of Mutai's plea, 10, rejected it, and 0 abstained. 

Kericho Governor Erick Mutai survived impeachment after Senators upheld his preliminary objection, citing the County Assembly's failure to meet the two-thirds threshold.

Thirty-four senators voted in favour of Mutai's plea, ten rejected it, and zero abstained. The senators voted electronically.

"Honourable Senators, the result for the division is as follows; Ayes are thirty-four, Nays ten and abstention at zero, so the ayes have it," Senate Speaker Amason Kingi declared.

"Honourable senators, the motion having been approved, the hearing proceedings on the proposed removal from office by the impeachment of honourable Dr Erick Kimutai, the Governor of Kericho County, hereby terminates and the senate now stands adjourned."

Governor Mutai contended that the County Assembly failed to meet the two-thirds threshold required for his impeachment.

While thirty-one out of forty-seven MCAs voted for the impeachment, the county chief asserted that thirty-two votes were necessary to validly carry out the process.

The county boss also faced charges of gross violation of the Constitution, 2010 and other laws, abuse of office, flouting the Leadership and Integrity Act, violation of the Public Finance Management Act, 2012, misappropriation of public funds, illegal drawing of county revenue, and engaging in indecent sexual acts.

He pleaded not guilty to all charges advanced by the county assembly

Speaker Amason Kingi adjourned the house until Tuesday, October 15, 2024, a day before the Senate begins to hear the impeachment resolution of Deputy President Rigathi Gachagua.
