Malala loses court battle to reclaim UDA Secretary-General position
Justice Bahati Mwamuye on Monday overturned the Political Parties Disputes Tribunal (PPDT) decision that had temporarily reinstated Malala.
Cleophas Malala’s efforts to hold onto the United Democratic Alliance (UDA) Secretary-General position ended in defeat after the High Court ruled against him.

The court found that the Gazette notice published on August 19, 2024, which announced Malala’s removal, remains effective and enforceable.
"The first respondent’s appeal before the PPDT is hereby terminated and shall not proceed before the tribunal. Any orders previously issued in favour of the respondent are hereby vacated," Justice Mwamuye ruled.
Adding to Malala’s troubles, the High Court also nullified all proceedings at the PPDT, making it impossible for him to continue contesting his ouster through that forum.
The judgment clears the way for Hassan Omar, who has already been serving in an acting capacity, to continue as the legitimate Secretary-General of UDA.
Hassan, a former Mombasa Senator and a trusted ally of President William Ruto, is expected to take the lead as the party gears up for future political contests.
Malala, who protested his dismissal, had described it as both unlawful and politically driven. His removal was decided during a United Democratic Alliance National Executive Committee (NEC) meeting held in August 2024.
After Malala’s exit, the party leadership swiftly appointed Hassan, then the Vice Chairperson, as Acting Secretary-General.
"The appointment of Cleophas Malala as the interim Secretary General is hereby revoked. These changes are effective immediately," stated UDA’s communication to members.
According to the party, Malala’s removal followed "wide and consultative deliberations" aimed at addressing internal challenges and shaping a stronger leadership team.
