The charge, under the Anti-Corruption and Economic Crimes Act 2003 and Public Procurement and Asset Disposal Act 2015, involved Sh3 million tenders awarded to Chilongola Holdings Ltd and Rome Investment (K) Limited that are allegedly associated with him.
Mbito is accused of harbouring direct private interest in the tenders despite being Kwale county government head of the treasury.

He denied the two charges and was released on a Sh1 million bond and one surety with an alternative cash bail of Sh300,000.
The matter being prosecuted by Senior Assistant DPP Peter Kiprop and Prosecution Counsel Yassir Mohamed and Victor Simbi is set for pre-trial on March 12, 2024.
