Director of Public Prosecutions (DPP) Renson Ingonga dropped charges against Mutinda, who has been directed to assist the police in capturing two other suspects who remain at large.
"The DPP has directed Albanus (Mutinda) to be freed as he will be a witness. He will also assist in the apprehension of two more suspects at large," State Prosecutor Joyce Olajo told Milimani Chief Magistrate Lucas Onyina.
Kithuka, who has been in custody since March 3, 2025, will be arraigned at the High Court in Makadara on March 26, 2025 to answer to murder charges. He has been remanded at Capitol Hill police station until then.
On Monday, the prosecution sought an additional day for the DPP to finalize his decision.
"The DPP's office received the file on the two suspects, Alex Mutua Kithuka and Albanus Mutinda Nzioka, on Friday. He needed time to read through the entire investigation diary before arriving at a decision on the nature of charges to file against the suspects," Olajo told the court.
Campbell Scott arrived in Kenya on February 15, 2025, a day after Valentine's Day, and checked into a hotel in Westlands, Nairobi.
The court heard that he went missing the following day, and his body was later found hidden in a thicket along the Machakos-Wote Road.
Preliminary investigations revealed that Scott was last seen leaving Westlands on February 16, 2025 with an unidentified man.
It was later discovered that he had been taken to Pipeline Estate in Nairobi's Eastlands, where it is believed he was murdered in a house belonging to Kithuka.
The court also heard that attempts were made to withdraw money from Scott's Visa cards in Nairobi, Voi, and Mombasa.
Investigators allege that Kithuka had already vacated his residence and moved his belongings to an undisclosed location before his arrest.
"The suspect, Kithuka is believed to have removed Campbell’s body and transported it to an unknown place while moving his household goods and belongings from his Pipeline residence," the prosecutor stated.
The prosecution argued that releasing the suspects would interfere with the investigation, given the seriousness of the crime and the ongoing search for more suspects.
On March 3, Magistrate Onyina granted the prosecution’s request to detain the two for 21 days to allow investigators to conclude their probe.
