Gatundu MP Gabriel Kagombe released on cash bail of Sh1 million

Machakos High Court has released Gatundu MP Gabriel Kagombe on a cash bail of Sh1 million with an alternative bond of Sh2 million  after he denied murder charges levelled against him.

Kagombe was charged with the murder of bodaboda rider David Nduati Wataha at the Kimuchu area within Makongeni in Thika West, Kiambu County, on May 17, 2024.

The prosecution accused him of committing the crime in contravention of Section 203, as read with Section 204 of the Penal Code.

However, the MP denied the charges before Justice Francis Rayola, who restrained him from contacting witnesses in the case either by himself or by proxies, lest the bond be cancelled.

He also ordered the MP to stay away from the scene of the crime and its surroundings.

The Office of the Director of Public Prosecutions (ODPP) didn't oppose bail and bond terms.

Justice Francis Rayola had on Monday, ordered the lawmaker to undergo a mental assessment test before being formally charged with murder as required by the law.

He further directed police to escort Kagombe to Kiambu Level 4 hospital for the psychiatrist test.

The suspect was detained at the Muthaiga Police Station pending the exercise and his appearance before the court.

Kagombe was arrested on Friday, May 31, after the ODPP approved the murder charges against him.

He was accused of shooting the boda boda rider, David Nduati Wahata, during a commotion that followed a dispute over ownership of a market in the area.

Ballistics conducted on all firearms that were at the scene on the fateful day linked Kagombe to the weapon that discharged the bullet.
