German freed on strict bond terms in child sexual abuse case in Kilifi

Kilifi court releases Netzband Tim Marvin on a Sh1 million bond with two Kenyan sureties.

A German national, charged before a Kilifi court with child sexual exploitation, has been released on strict bond terms including providing two Kenyan sureties.

Chief Magistrate Julius Nangea granted Netzband Tim Marvin, said to be a businessman in Kilifi County, a Sh1 million bond with the two sureties.

Marvin is charged with three counts of child trafficking, child pornography and promoting sexual offences with a child.

In the first count, he is charged with trafficking in persons, contrary to section 3(1) (e) as read with sections 3(4) and 3(5) of the Counter-Trafficking in Persons Act no 8 of 2020.

It is alleged that between January 1 and February 9, 2024, in the Mtondia area of Kilifi North Sub-county in Kilifi, he sexually exploited 15- year old child after transporting her using his Mercedes Benz, registration 86120W, from the Maghreb Hotel Sea Horse area to his house in Mtondia.

In the second count of child pornography, contrary to section 24(1) (c) of the Computer Misuse and Cyber-Crimes Act no 5 of 2018, it is alleged that on an unknown date in Mtondia, Marvin transmitted images of his private parts to the victim using his mobile phone, via WhatsApp.

In the third count, Marvin is charged with promoting a sexual offence with a child, contrary to section 12(a) of the Sexual Offences Act no.3 of 2006.

The allegation is that on February 6, 2024, at an unknown place in Kenya, he promoted a sexual act with a child aged 15 years by distributing a picture of his private parts through WhatsApp.

The case being prosecuted by Assistant Director of Public Prosecutions (DPP) Vivian Kambaga and prosecution counsel Nancy Njeru will be heard on March 14, 2024.
