Senate gazettes three-day special sitting for Kericho Governor Erick Mutai's impeachment trial

According to the gazette notice published on Thursday, the sessions will run from August 27 to 29, commencing at 9:00 am each day at the Senate Chambers in Nairobi.

Senate Speaker Amason Kingi has gazetted three special sittings of the Senate to hear the impeachment case against Kericho Governor Erick Mutai, following a resolution by Senators to deliberate on the matter in plenary.

According to the gazette notice published on Thursday, the sessions will run from August 27 to 29, commencing at 9:00 am each day at the Senate Chambers in Nairobi.

Kingi said the sittings, convened under Section 33(3) of the County Governments Act and Senate Standing Orders 80 and 33, will focus solely on hearing the charges against the governor.

“No other business will be transacted during the special sittings, and the Senate will thereafter adjourn until Tuesday, September 23, 2025,” reads the notice.

The gazettement follows a resolution by the House to handle the matter in plenary instead of referring it to a special committee. Senate Majority Leader Aaron Cheruiyot had earlier sought the formation of an 11-member committee to investigate the charges, but his motion failed after Minority Leader Stewart Madzayo declined to second it.

Deputy Speaker Kathuri Murungi later suggested an alternative approach, which the Speaker also ruled out.

Governor Mutai was impeached last Friday after 33 out of 47 Members of the Kericho County Assembly voted in favour of a motion tabled by Sigowet MCA Kiprotich Rogony.

Speaker Kingi confirmed to Senators on Wednesday that he had received official communication from the county assembly outlining the grounds for the governor’s removal.

Mutai faces three charges, including gross violation of the Constitution and misuse of county funds, abuse of office and gross misconduct.

The charges include allegations of authorising fictitious payments worth Sh85.7 million for undelivered goods, awarding inflated contracts, presiding over incomplete works, making irregular appointments and contempt of court orders.

This is the second time the Kericho governor is facing an impeachment trial before the Senate. He survived an earlier attempt in October 2024 when the county assembly failed to meet the constitutional two-thirds voting threshold.

Senators will next week determine whether to uphold the charges and remove him from office or dismiss the impeachment.
