On July 11, Maiyo’s legal team, led by the vice-president of the Law Society of Kenya (LSK), Mwaura Kabata, called for the charges against the businessman to be dropped, pointing out that no formal charges had been filed.
The DCI had earlier indicated that Maiyo would be arraigned at Kahawa Law Courts.
“The DCI failed to arraign him in court despite claiming he would be presented at Kahawa Law Courts. This is a total infringement on his rights,” the lawyers stated in a press release.
Reports indicate that Maiyo was taken to Milimani Law Courts hours before his release, but was not presented for arraignment.
Instead, he was returned to Muthaiga Police Station, where he was later released on bail.
A police cash bail allows a person who has been arrested to remain free while awaiting their court appearance, usually issued at the station.
Maiyo, popularly known as Kan on social media, was detained following a viral video in which he is alleged to have incited violence against police officers and their families.
He has built a reputation on TikTok for openly criticising government shortcomings and police misconduct.
Although the DCI has not confirmed the exact video that led to his arrest, one recent clip shows Maiyo pleading with officers to stop the abductions of unarmed Kenyans and refusing to be used as tools by powerful interests.
In this video, he urges the officers to consider their own families, children, siblings, and loved ones when ordered to abduct activists.
Maiyo has also posted content reacting to recent events, such as the death of blogger Albert Ojwang, who died while in police custody.
The businessman is expected to appear at Milimani Law Courts on July 14, 2025, at 8:00 am.
Meanwhile, his lawyers maintain that the case be dropped due to a lack of charges and continued violation of his rights.
