Court bars DCI from summoning Nairobi Hospital officials amid leadership wrangles

The High Court in Nairobi has issued interim orders restraining the Directorate of Criminal Investigations (DCI) from summoning or intimidating officials involved in the ongoing leadership disputes at The Nairobi Hospital.

Justice Nixon Sifuna, sitting at the Milimani High Court, made the ruling following an urgent application filed on August 28, 2025, by the Kenya Hospital Association, which manages the facility.

The association had raised concerns that the DCI was summoning officials and witnesses over matters already pending before the court.

In his directions, Justice Sifuna ordered that the application be served on the defendants immediately, with responses filed within four days. The applicants were also granted leave to file supplementary affidavits if necessary.

“Pending the hearing and determination of the application, an interim order of injunction is hereby issued, restraining and forbidding the DCI, its Director, as well as all the officers under his command, from summoning, threatening, questioning, detaining, or in any way interfering with the peace and liberty of any persons who are parties or witnesses in this suit,” the judge directed.

The court further suspended all summons recently issued by the DCI to Nairobi Hospital officials, including Dr Obwaka, Dr Otieno, and Prof Manyora, until further notice.

Justice Sifuna also ordered that the directions be served on the DCI Director, the Inspector General of Police, and the officers who signed the contested summons for compliance.

The matter is scheduled to be mentioned on September 23, 2025, for confirmation of compliance and further directions.
