Protests erupt over land tussle pitting Riyadha Mosque and Mumbai Mall in Gikomba

The protest arose from a dispute over a lease agreement between Pumwani Riyadha Mosque and Mumbai Mall shopping centre management. Mosque officials claim they are owed Sh80 million in unpaid rent since leasing the land in 2008.

Business operations at a Mumbai shopping centre in Gikomba, Kamkunji Constituency, came to a standstill on Friday following protests led by the Muslim community from Pumwani at the Riyadha Mosque.

The protest arose from a dispute over a lease agreement between Pumwani Riyadha Mosque and Mumbai Mall shopping centre management. Mosque officials claim they are owed Sh80 million in unpaid rent since leasing the land in 2008.

Zacharia Abdulla, the Imam and chairperson of Pumwani Riyadha Mosque, expressed frustration over the situation. "Despite owning property worth millions, we find ourselves begging for our dues. Many families and children depend on the mosque, but our inability to receive payments has left us unable to support them."

Zacharia explained that an agreement was made in 2007, stipulating monthly rent payments of Sh500,000 starting in 2010, which the management failed to fulfil. He also raised concerns about intimidation tactics and instances where title deeds were changed without consent.

Omar Ahmed Sheikh, an administrator of the mosque, noted that the Mumbai shopping centre was leased to support the Gikomba Business Centre.

"The land was leased when we were young, with the agreement for a monthly payment of Sh500,000 over 22 years. However, despite the lease having six years remaining, they have not made any payments. In 2015, we attempted conflict resolution, which they defaulted on," Omar explained.

He said they have pursued legal avenues and sought assistance from other mosques but have not received any help.

"We cannot allow business to continue as usual. We demand full payment of the mosque's dues, which amount to Sh80 million. Any other unresolved agreements should also be addressed," he added.

Omar stressed the need for a definitive solution, citing past challenges with corruption allegations and being unfairly labelled as criminals.

During the protest, demonstrators carried a coffin to symbolise their prolonged suffering and the hardship of not receiving their wages and daily earnings. According to the community, they allege that whenever the issue is raised, individuals have mysteriously disappeared over the years.

Zena Ali, a resident and worker at Pumwani Riyadha Mosque, highlighted their struggles, stating they have endured nearly three months without pay. "Many people rely on the mosque for medical assistance, scholarships, and even burials. Currently, the mosque owes money to cemeteries that remain unpaid."

Zena also pointed out that due to non-payment, the mosque frequently faces issues like electricity and water shortages. "The mosque is supposed to support us, but now we have to fundraise to keep it running, which is very distressing." The Mumbai shopping centre is allegedly indebted Sh80 million to the mosque.

Salim Juma, a community leader and advocate for peace, highlighted the challenges faced by the mosque, including unpaid bills affecting many aspects of community life.

"There are outstanding bills for Madrasa teachers, as well as unpaid water bills, which are causing significant difficulties. This property rightfully belongs to us, the residents of many youths lack jobs, and, unfortunately, we continue being frustrated."

Salim highlighted the government's responsibility to support Majengo residents in obtaining their rightful entitlements.

According to Steve Mwonge, acting Deputy County Commissioner, they received reports on the issue and stepped in early in the morning upon noticing the issue escalating.

"We brought together the mosque management and the caretaker of Mumbai Mall to resolve the issue but due to some unresolved details, we've rescheduled the meeting for Monday to ensure a comprehensive resolution," he said.

He stressed the need for all parties to exercise patience and tolerance. "By prioritising reason, we can swiftly resolve this issue. I urge everyone to maintain peace throughout this process," he added.
