Legal challenges won’t disrupt patient care, Nairobi Hospital assures

A court order in December had placed temporary restrictions on the governance and financial operations of the hospital, which could potentially affect its ability to deliver services to thousands of patients daily.

The Kenya Hospital Association (KHA), responsible for Nairobi Hospital, has assured the public that it will continue to provide high-quality healthcare despite a temporary court order suspending recent governance decisions.

This follows the court’s ruling on December 4, 2024, which suspended the implementation of a resolution regarding the election of directors to the board of management and the election of trustees of the association.

The suspension remains in effect until the case is heard and determined.

Acting CEO of Nairobi Hospital Felix Osano, confirmed that the institution would comply with the court order, but he also emphasised that they would seek appropriate legal remedies.

“The restrictions and inconveniences notwithstanding, as a law-abiding institution, we fully respect the judicial process and will comply with the orders while seeking appropriate remedies before the court,” Osano in a statement.

The legal dispute was initiated by Samuel Mithamo Muchiri, who has filed a case against the hospital’s board of management and trustees.

Muchiri alleges that the defendants failed to submit an updated index of members to the Registrar of Companies. He also claims that the board engaged in significant acts of malfeasance, violating their duty to act in the best interests of the institution.

Muchiri further argues that the hospital has suffered losses exceeding Sh1.5 billion and faces a financial burden with supplier debts amounting to nearly Sh3 billion.

Despite the ongoing legal battle, Nairobi Hospital said it remains committed to providing uninterrupted healthcare services to its patients.

Osano noted that the court’s order had placed temporary restrictions on the governance and financial operations of the hospital, which could potentially affect its ability to deliver services to thousands of patients daily.

"The court order places temporary restrictions on our governance and financial operations, which could negatively affect service delivery to thousands of patients daily," Osano added.
