Court allows DCI to detain suspects in murder of Briton Campbell Scott in Embakasi

Kithuka had relocated to a different house after Scott's body was found and before he was arrested by the DCI's Homicides Unit.
Police have obtained orders to detain two men suspected of having murdered British national Campbell Scott at his house in Embakasi, Nairobi before his body was dumped at the Makongo forest in Makueni County.
The orders were granted by Chief Magistrate Lucas Onyina.

The first suspect, Alex Mutua Kithuka, is being held at Capitol Hill Police Station in Nairobi after the Directorate of Criminal Investigations (DCI) obtained orders from the courts to hold him for 21 days pending investigations.
Kithuka had relocated to a different house after Scott's body was found and before he was arrested by the DCI's Homicides Unit.
His suspected accomplice, Albunus Mutinda Nzioki, will be held at the Kilimani Police Station.
Scott arrived into the country on February 15 to attend a conference and was booked at JW Marriot Hotel in Westlands.
In an affidavit filed at the Milimani Law Courts, Corporal Philip Kilonzo of DCI's Homicides Unit stated that his team has interviewed several witnesses on the movements of the deceased.
The deceased was also captured leaving a different hotel with an unidentified man and boarded a taxi and headed to Pipeline area in Nairobi (to Kithuka's house), stated Cpl. Kilonzo.
"Preliminary investigations have revealed that the deceased person was taken to Pipeline Estate to a house belonging to (Kithuka) where it is believed the deceased person was murdered and body disposed of at Makongo forest," said Cpl. Kilonzo.
"Preliminary investigations reveal that thereafter, there were several successful attempts of withdrawal of money from the deceased's personal account within Nairobi, Voi and Mombasa."
Cpl. Kilonzo said the DCI is investigating a case of murder.
After Scott went missing, his body was found along Machakos-Wote road by a herder. A post-mortem did not reveal the cause of his death but a toxicology report is being awaited.
Scott had been reported missing at the Parklands Police Station by his colleague Michael Edwards.
Cpl. Kilonzo said the two men are suspected to have been involved in the murder and sought to detain them for 21 days.
"The respondents (Kithuka and Nzioki) continued stay in police cells without an order of court will contravene their constitutional rights and releasing them will jeopardise investigations owing to the seriousness of the case and the fact that investigations are ongoing for recovery of the handset and SIM card in view of arresting other suspects who are connected to the heinous act," stated Cpl. Kilonzo.
The suspects did not object to the request for their detention but indicated to the court that the period of 21 days was lengthy.
