Moses Dola released from prison after serving 9-year prison sentence for killing wife

He was released by Justice Alexander Muteti after he convinced the court to grant him an early release from prison.
Former journalist Moses Dola who was serving a jail term of 10 years for killing his wife after he pleaded guilty to manslaughter has been released from prison following an application for review of his sentence.

Dola had told the court unequivocally that he regrets his actions and has learnt very useful lessons throughout the period he has been in custody.
Justice Muteti said he takes cognizance of the fact that the deceased and the applicant (Dola) had a child who has not had the benefit of enjoying parental love.
The judge said the predicament of the child is a factor that this court has taken into account and as a result, the court is inclined to grant the prayer for release.
"The death was highly regrettable but since the applicant has served the better part of his sentence, the remaining four months may not make much of a difference. The applicant has learnt the things he must never do in his life, hopefully. Consequently, this court allows the applicant's (Dola's) application and his term of imprisonment is reduced to the period already served," stated Justice Muteti.
"It is a case of tampering justice with mercy. It is the hope of this court that the applicant (Dola) shall find a way of making his son understand why the mother lost her life in his hands. It is not an easy task and the families of the accused and that of the deceased must help the applicant and his son overcome the loss."
Domestic fight
Dola killed his wife Sarah Wambui Kabiru during a domestic fight at their home in Umoja, Nairobi in 2011. Dola had told the court that he regrets the incident.
Muteti said Dola made a compelling case for release considering that he has expressed deep remorse for the loss of the deceased's life.
The judge also noted that Dola went into prison at the age of 29 and is turning 43 in October this year, adding that he has spent the crucial portion of his youth life in prison.
Dola intends to start studying law at the Strathmore University in July this year.
"He has indeed made a very compelling case for release considering that he expressed deep remorse for the loss of the deceased's life," stated Muteti.
