High Court directs IG Kanja to restore former CS Justin Muturi’s security detail

The judge warned Kanja and others that any disobedience or non-observance of the court order will result in penal consequences to him or any other person disobeying and not observing the same.
The High Court has ordered Inspector General of Police Douglas Kanja to reinstate police officers attached to former Public Service Cabinet Secretary Justin Muturi.
Justice Enock Chacha Mwita issued the interim orders following a petition filed by Muturi against the State Law Office and the National Police Service Commission (NPSC).

The court found that the petition raised serious constitutional issues regarding the rights of Muturi, who has served as Attorney General and Speaker of the National Assembly in the past.
Muturi had sought the Judiciary's intervention, which the court found deserving urgency.
"Upon considering the pleadings, I am satisfied that the petition and application raise fundamental questions regarding the petitioner's rights requiring this court's immediate intervention,” stated Justice Mwita.
"In the meantime, a conservatory order is hereby issued directing the Inspector General of Police to immediately reinstate or restore security of Hon Justin Muturi, the former Speaker of the National Assembly, and not to withdraw the security or interfere with it in any other manner until 24th June 2025."

Justice Mwita also directed the IG, the National Police Service, office of Attorney General and the NPSC to file and serve their responses to Muturi's application and the petition within 14 days of service.
Muturi will thereafter have an additional 14 days to file and serve a supplementary affidavit, if necessary, together with written submissions not exceeding 10 pages as reply to the responses by the respondents.
The AG's office, NPSC and the NPS will also have 14 days after being served to file their written submissions, equally not exceeding 10 pages.
The matter is set for a mention on June 24, this year when parties in the petition will highlight their submissions.
