DPP seeks Sh2 billion fund to boost justice delivery, promote accountability

The Office of the Director of Public Prosecutions is pushing for the establishment of a dedicated Public Prosecutions Fund, with an initial allocation of Sh2 billion, to strengthen its capacity to deliver justice effectively and respond to modern challenges in criminal investigations.
DPP Renson Ingonga and National Treasury Cabinet Secretary John Mbadi made the request during a session with the National Assembly Committee on Delegated Legislation, where they presented the proposed Public Finance Management (Public Prosecutions Fund) Regulations, 2025.

The regulations will provide the legal framework to manage the fund once approved by Parliament.
The proposed fund is expected to improve the ability of the ODPP to carry out complex investigations, tackle emerging crime patterns, and support asset recovery efforts, which the DPP said have been hampered by lack of funding.
“We depend on the National Treasury,” said Ingonga, noting that limited financial resources have constrained key areas of the ODPP's work.
Chepkonga, who chairs the committee, listened as both officials laid out the pressing needs facing the ODPP and why the fund is necessary to ensure timely and effective prosecutions.
Mbadi emphasised the urgent need to equip the ODPP to deal with evolving crime trends and technological advancements, which he said have increased the complexity of criminal cases across the country. He explained that the Sh2 billion request forms part of a broader national push to strengthen the justice system and promote accountability.
“The ODPP faces many challenges, including new and emerging crime trends and advancements in ICT,” Mbadi told the MPs. “This fund would be part of a national collective effort in strengthening the criminal justice system and enhancing accountability.”
The proposal is now awaiting approval by Parliament, which will decide whether to adopt the draft regulations and give the green light for the creation of the fund.
