Justice Isaac Lenaola issues demand letter to Captain Kung’u Muigai over bribery allegations

In a demand letter dated September 16, 2025, and sent by the law firm Ngeri, Omiti and Bush Advocates LLP, Justice Lenaola’s lawyers described the claims as false, malicious, and defamatory.

Captain Kung’u Muigai is facing a legal demand from Supreme Court Justice Isaac Lenaola over a TikTok video in which he allegedly accused the judge of taking a Sh1 million bribe and participating in a wider judiciary corruption scandal.

In a demand letter dated September 16, 2025, and sent by the law firm Ngeri, Omiti and Bush Advocates LLP, Justice Lenaola’s lawyers described the claims as false, malicious, and defamatory.

“We act for Justice Isaac Lenaola, CBS, Justice of the Supreme Court of Kenya, who has instructed us to write to you after his attention was drawn to an online video you posted on September 8, 2025, on a TikTok account known as DG DG (@udgmedia),” the lawyers wrote.

“In the video, headlined Judiciary exposed!! Top judges mentioned in a mega bribery scandal, you maliciously made false, threatening and disparaging allegations against our client without any justification.”

The lawyers said the video has already attracted thousands of likes, comments, saves, and reposts, potentially harming the judge’s reputation and public confidence in the judiciary. They noted that the statements were never verified with Justice Lenaola or his representatives before publication.

In the clip, Muigai allegedly claimed that Justice Lenaola, while presiding over a long-running commercial dispute involving Benjoh Amalgamated Limited, Muiri Coffee Estate, and Kenya Commercial Bank, received a Sh1 million bribe “in a supermarket parking lot” before ruling against him.

“I learnt through the same employee of the bank’s lawyer that Justice Lenaola received a million shillings in a parking lot of some supermarket, which I can disclose in camera, and that’s why he ruled like that. After that, the bank got emboldened and sold Muiri Coffee Estate, which was just a guarantor. I can tell Kenyans our judiciary is corrupt to the core. It is corrupt. They take money openly and they make judgments the way they want," Muigai allegedly said in the video, according to the lawyers’ letter.

Justice Lenaola’s lawyers dismissed the allegations as fabricated and malicious, saying they were intended to embarrass and injure their client’s reputation. They pointed out that Muigai appeared before Justice Lenaola several times between January and July 2004 when the case was heard and never raised claims of bribery at the time.

"Our firm instructions are, therefore, that your statements are not only misleading, degrading, defamatory but also completely inaccurate, and made with the malicious intent of besmirching our Client's reputation as well as his personal and professional integrity in the society, knowing very well that he has been a Judge since 2003 and is currently a Justice of the Supreme Court of Kenya," the lawyers stated."Not once did you raise any complaint as to how our Client was handling the matter, not least that he had been compromised," they added.

The letter also pointed out that Muigai previously filed a complaint before the Judicial Service Commission against ten judges, including Justice Lenaola, which was dismissed on June 30, 2025, for lack of merit.

"We are instructed that, as a matter of fact, on 10th October, 2024, you filed a complaint against ten (10) Judges of the Supreme Court and Court of Appeal, including our Client, before the Judicial Service Commission. On 30th June, 2025, JSC determined, with finality, that your complaint was lacking in merit and summarily dismissed it."

The lawyers have demanded that Muigai retract the video, publish an unreserved apology, and stop making further defamatory remarks. They warned that failure to comply within seven days would result in legal proceedings seeking damages and other appropriate orders.

"Unless you comply with this demand within Seven (7) days upon receipt of this letter, our instructions are to take such further steps in this matter as may be necessary, including the institution of legal proceedings against you, to obtain appropriate Orders and damages, at your sole peril as to costs and other attendant consequences without any further reference to you whatsoever," the letter read.
