DJ Joe Mfalme, 5 others to be state witnesses in detective's murder case

Allan Ochieng, the first respondent in the case, has been remanded seven days ahead of formal charges at the Kiambu High Court.

Joseph Mwenda, popularly known as DJ Joe Mfalme, and five others will be state witnesses in the murder of Dagoretti Deputy DCI Commander Felix Kintosi.

This development came on Monday after the office of the Director of Public Prosecutions (ODPP) decided to charge his associate Allan Ochieng with Kintosi's murder and listed the DJ and five others, including two police officers, as prosecution witnesses in the case.

In an April 8, 2024, letter to the court, the ODPP stated that only Ochieng, the first respondent in the case, would face murder charges. He was taken to the Kiambu Law Courts, where he was remanded for seven days, awaiting preparations for formal charges at the Kîambu High Court.

Ochieng will be charged with murder, according to Section 203, as read with Section 204 of the Penal Code.

The suspect allegedly assaulted Inspector Kintosi in an altercation at about 4 am on March 16, 2024, after an accident near the Kikuyu Police Station in Kiambu County. The officer died a few days later at the Nairobi West Hospital.

Ochieng’s lawyer protested the decision of the ODPP and Directorate of Criminal Investigations (DCI) to take him to the Kiambu court, saying it was not communicated to them and that his family was awaiting directions at the Kibera Law Courts.

The seven had been detained in Kibera, on the order of Senior Principal Magistrate Margaret Murage, and should have been returned to the court for termination of the custodial orders before Ochieng was taken to Kiambu.

The latter move amounted to contempt of court by the ODPP and DCI.

Lawyer Nganga Mbungua and others who represented the suspects who were discharged said they were not opposed to the ODPP’s decision. They prayed for the release of the DJ's vehicle from the Kabete Police Station, the Dagoretti headquarters of the DCI, where investigations into the case were undertaken.

Inspector Fredrick Kosen, however, opposed the application and told the court that the car was part of the evidence against Ochieng.

DJ Joe Mfalme and the other suspects had spent 14 days in detention as the DCI probed the murder. Murage granted the DCI the order to detain them after they were arrested over the murder.
