Lawyer moves to court to bar Kenya Forest Service from managing City Park

Senior Counsel Charles Mugane argues that the management of City Park rightfully belongs to the Nairobi County Government and was unlawfully taken over by KFS.

A city lawyer has filed a case in court seeking orders to bar the Kenya Forest Service (KFS) from managing and collecting revenue at Nairobi's historic City Park.

In his petition, Senior Counsel Charles Mugane argues that the management of City Park rightfully belongs to the Nairobi County Government and was unlawfully taken over by KFS.

He claims the park was among several functions transferred from the county to the national government during the tenure of former governor Mike Mbuvi Sonko in 2018.

Mugane accuses KFS officers of harassing visitors and collecting entrance fees that are not remitted to government accounts.

He says the agency's continued involvement in the park's affairs has led to a lack of accountability and hindered public enjoyment of the recreational facility.

According to the lawyer, other devolved functions such as health, transport, and education were also transferred from City Hall around the same period, with related revenues allegedly being handled through the National Bank of Kenya.

"The revenue being collected by the Kenya Forest Service at City Park cannot be accounted for, and visitors can no longer freely enjoy bird and animal viewing as before," the lawyer states in court papers.

He now wants the court to issue an order restraining the KFS from interfering with or participating in the management of City Park pending the hearing and determination of the case.
