ODM decries impact of delays in appointing IEBC selection panel as wait for by-elections continues

The Orange Democratic Movement (ODM) has raised the alarm over the ongoing delays in appointing the Independent Electoral and Boundaries Commission (IEBC) selection panel, describing the situation as disruptive to the nation's electoral processes.
This concern was expressed following a meeting of the party's central committee, led by Kisumu Governor Anyang' Nyong'o.

In a statement on Friday, ODM noted how these delays are affecting several important electoral matters, particularly by-elections in Ugunja and Magarini, and the clearance of a nominated Member of Parliament, all seats previously held by the party.
The delay has hindered the recruitment of the seven commissioners essential for facilitating elections across the country.
"ODM as a party is one of the most affected by this continued state of affairs. We are down three members in the National Assembly alone with pending by-elections in Ugunja, Magarini and one nominated member, all of which were held by ODM," the party said.
The selection panel is critical for appointing commissioners to the IEBC, which will play a central role in organising future elections.
The delay in the panel's formation not only stalls these immediate by-elections but also threatens to push back preparations for the 2027 General Election.
National urgency
ODM urged the Judiciary to hasten petitions related to the by-elections, stressing that these cases should be treated with national urgency.
In addition to the party's specific concerns, the country currently faces 11 pending by-elections, triggered by various reasons including the deaths of members of county assemblies (MCAs) and the elevation of former Ugunja MP Opiyo Wandayi and former nominated MP John Mbadi to Cabinet positions by President William Ruto.
The Constitution stipulates that by-elections be held within 90 days whenever a vacancy occurs in an electoral area.
However, the lack of a functioning electoral commission has made this impossible, leaving the country in a state of electoral uncertainty.
As ODM grapples with these delays, it also raised concerns about the time it will take for new commissioners to settle in and begin preparations for the highly anticipated 2027 General Election.
