He further emphasised that the application filed by Wanjigi earlier this week focused solely on the issue of arrest, not prosecution.
Wanjigi's advocate, Willis Otieno, requested an extension this morning, stating, "Several things have happened that we will be seeking to bring to the attention of this court that will necessitate an amendment of the application." That's why we are pleading for the order. There will be no prejudice to be suffered."
However, the Director of Public Prosecutions (DPP) opposed the order, arguing that Otieno's request was not substantiated by the original pleadings.
"Otieno is asking for what has not been pleaded," the DPP stated, adding, "They are trying to preempt our grounds of opposition, in which we indicate they have failed to demonstrate how we have threatened the rights of the petitioner. I am opposed to granting an order that will bar charges."
Following arguments from both sides, Justice Mwamuye granted Wanjigi seven days to file and serve an amended petition. The matter will now be mentioned on September 19.
