Azziad Nasenya moves to court to stop auction of Sh20 million Kileleshwa apartment

Media personality and content creator Azziad Nasenya has turned to the Commercial Court in Nairobi seeking orders to stop the auction of her Kileleshwa apartment valued at Sh20 million.
In her suit, Azziad accuses a savings and credit cooperative society (Sacco) of unlawfully attempting to auction her home despite her having cleared all pending loan arrears.

She wants the court to restrain the Sacco and its appointed auctioneers from proceeding with the sale first scheduled for October 8, 2025.
Court documents show that Azziad, a registered member of the Sacco, acquired the apartment through a mortgage financing arrangement. She claims that after identifying the property, she applied for and was granted a loan of Sh20,389,720 on April 14, 2024, to facilitate the purchase.
Two days later, a loan agreement was executed, and by June 12, 2024, the property had been charged to the institution as security for the facility before being transferred to her name.
Azziad says she began repaying the loan as agreed and had remitted Sh897,924.68 by the time the dispute arose. However, she admits that she later fell into arrears amounting to Sh1.5 million due to the prevailing economic hardships affecting many Kenyans.
According to her affidavit, the Sacco went ahead to deduct Sh2.45 million from her savings account on September 19, 2025, effectively clearing all the outstanding arrears.
Despite this, she was allegedly shocked to learn that the Sacco had instructed auctioneers to advertise her property for sale just five days later, on September 24, over an alleged balance of Sh21.88 million.
Through her lawyers, Azziad argues that the move to auction the property was "unlawful, premature, and in bad faith", insisting that she had complied with her loan repayment obligations.
She further contends that the Sacco's action violates the terms of the charge agreement, which, according to her, explicitly bars the lender from recalling the entire loan before the agreed repayment period lapses.
"The court will note that recital 'B' of the charge expressly provides that the chargee shall not demand repayment outside the time specified by the agreement," reads part of her court papers.
Azziad now wants the court to intervene and declare the intended auction illegal and void, pending the full determination of her case. The matter is set to be mentioned for directions.
