Court vindicates slain lawyer Kyalo Mbobu in disputed multi-million loan case
The court found that the late advocate had been unfairly pursued over an informal loan agreement that ballooned far beyond the original amount advanced.
The High Court has ruled in favour of the estate of slain lawyer Mathew Kyalo Mbobu, vindicating him in a long-running commercial dispute that had dogged him until his death.
Justice Moses Ado of the High Court's Commercial and Tax Division delivered the judgment after Mbobu's assassination in September 2025.

The court found that the late advocate had been unfairly pursued over an informal loan agreement that ballooned far beyond the original amount advanced.
According to court documents, the dispute revolved around a substantial sum that Mbobu allegedly borrowed several years ago under unclear terms.
The amount had been inflated through interest and penalties to what his lawyers described as "an unconscionable and unlawful claim."
In his ruling, Justice Ado noted that the lender failed to substantiate the figures presented to the court and had not demonstrated that the alleged loan was advanced within the confines of the law.
The judge therefore declared that the claims against Mbobu's estate were unfounded and unenforceable.
"The evidence before this court does not support the exaggerated claim advanced by the plaintiff. The alleged loan was informal, unregulated, and riddled with inconsistencies that render it unenforceable in law," Justice Ado stated.
He consequently struck out the case and ordered that the estate of the late Mbobu should not bear any liability in respect of the disputed debt.
Lawyer Mbobu, a prominent Nairobi advocate known for handling high-profile civil and commercial matters, was shot dead by unknown assailants on the night of September 14, 2025. His murder sent shockwaves through Kenya's legal fraternity, with the Law Society of Kenya (LSK) condemning the killing and calling for swift investigations.
At the time of his death, Mbobu was facing multiple legal battles arising from contentious financial transactions and client disputes.
He had reportedly complained of threats linked to some of the cases he was handling.
Police investigations into his killing are still ongoing, with no arrests made so far.
