Judge upholds DPP's decision to charge ex-Kabete MP Muchai murder suspects with robbery with violence

Justice Mugambi dismissed a petition filed by the suspects who claimed the State had subjected them to double jeopardy by initiating two criminal cases arising from the same incident and involving the same person.
Seven accused persons who are on trial for robbery with violence charges in the murder of former Kabete MP George Muchai have lost their bid to have the Director of Public Prosecutions (DPP) drop charges against them.
High Court Judge Lawrence Mugambi while upholding the DPP's decision to charge them, said the armed robbery charges were valid.

The court has already found the six with a case to answer in the robbery case and are now on their defence.
Previously, their defence hearing resumed before Milimani Chief Magistrate Lukas Onyina.
Those on trial are Erick Muyera Isabwa and his six co-accused: Raphael Kimani, Mustapha Kimani, Stephen Astiva, Jane Wanjiru, Margaret Njeri, and Simon Wambugu.
The robberies are alleged to have occurred hours before the accused persons are said to have killed Muchai, his driver and two bodyguards in the early hours of February 7, 2015, along Kenyatta Avenue.
They are facing another charge of murder before the High Court.
Isabwa, the main suspect in both cases, has since denied the robbery with violence charges.
This includes the violent robbery of six victims, among them two sisters, Gladys Waithera and Irene Muthoni.
Isabwa and Raphael Kimani have already taken the stand to defend themselves.
Isabwa had sought to discredit the prosecution's evidence, raising serious doubts about the credibility of the police's actions and testimonies.
