The matter came up before Milimani Senior Principal Magistrate Robinson Ondieki on Monday, where a reconciliation agreement executed by both sides was tabled.
The deal was anchored on Section 176 of the Criminal Procedure Code and Article 159(2)(c) of the Constitution, which promotes alternative dispute resolution in criminal proceedings.
According to the agreement, Ochora admitted fault and issued a formal apology, which Charlene accepted.
The settlement requires the writer to refrain from publishing, distributing, or disseminating the contested book or any other material referencing the events in question.
"The accused shall not publish, distribute, disseminate, or cause to be published in any form or medium the book or any material purporting to narrate in the first person the events forming the subject matter of this case," the agreement states.
In addition, Ochora is barred from transferring the rights of the book to third parties for commercial or creative purposes, including production or adaptation.
The agreement stipulates that a breach of these terms would entitle Charlene to seek civil redress, and the case withdrawal would not shield the accused from liability.
With the settlement in place, the court formally marked the criminal case, registered as MCCR No. 314 of 2025, as withdrawn.
The matter will be mentioned again on October 6, 2025, for further directions.
