Court bars businessman Kung’u Muigai from defaming Justice Isaac Lenaola

According to court documents, Kung'u Muigai is alleged to have linked Justice Lenaola and other senior judges to corruption and further insinuated their involvement in the death of lawyer Kyalo Mbobu.

The High Court has issued orders restraining businessman Kung'u Muigai from publishing or making further defamatory statements against Supreme Court Judge, Justice Isaac Lenaola.

Justice Nixon Sifuna, in a ruling delivered on Tuesday, granted an interim injunction barring Muigai or anyone acting on his behalf from circulating on any media or platform remarks considered defamatory of the judge.

The orders followed an urgent application filed by Justice Lenaola through his lawyers, accusing Muigai of making false, scandalous and malicious allegations in interviews given on September 8 and 12, 2025, which were later widely shared on social media.

According to court documents, Muigai is alleged to have linked Justice Lenaola and other senior judges to corruption and further insinuated their involvement in the death of lawyer Kyalo Mbobu.

The judge told the court that despite a demand notice requiring Muigai to retract his remarks, he continued to give fresh interviews, repeating the allegations and challenging him to sue.

Justice Lenaola argued that the attacks not only injured his reputation but also undermined the integrity of the Judiciary, which depends on public trust.

Justice Sifuna directed that the application be served within two days, with a response expected within five days of service. The applicant may, if necessary, file a supplementary affidavit within three days of receiving the response.

The matter will proceed by way of written submissions, with the court scheduled to give further directions on October 13, 2025.
