Boda boda rider charged with violently robbing DCI officer in Mihang'o

A man who allegedly robbed a Directorate of Criminal Investigations (DCI) officer of his gun in Njiru Sub-county, Nairobi, is facing charges of violent robbery at the Makadara Law Courts.
Moses Ndunda (not related to this writer) was charged with violently robbing detective constable Peter Mburu Irungu of his Ceska Pistol loaded with 15 bullets contrary to section 296 (2) of the Penal Code.

Ndunda is accused of committing the offence along Gesora Road in Mihang'o area jointly with others at large on August 18.
The suspect was also charged with robbing Irungu who is attached to the Anti-Terrorism Police Unit (ATPU's) Nairobi detachment of his mobile phone and the certificate of appointment with the National Police Service (NPS).
Irungu was walking home at around 4 am when he was attacked and robbed of his gun by two men on a motorcycle who were armed with knives while walking home at around 4 am.
The prosecution says Ndunda and his accomplices at large used actual violence on the detective during the alleged robbery.
Ndunda was also charged with possession of a firearm without a firearm certificate contrary to section 4 (2) (a) as read with 4 (3) (2) (b) of the Firearm Act. After he was allegedly found with Irungu's gun.
In the charge sheet, the accused person is said to have been found in possession of a firearm, a Ceska Pistol – without a firearm certificate in Dandora, Nairobi on October 23.
Registration particulars of the gun allegedly recovered from Ndunda indicate that it belongs to the Kenyan Police Service.
The suspect is facing an additional charge of being in possession of ammunition contrary to section 4 (1) (a) of the Firearm Act where he is accused of having possession of 14 rounds of ammunition (bullets) without a license.
Irungu was robbed of his gun while walking home along Gesora Road where his drinking buddies had abandoned him after they had a dispute where he is alleged to have threatened to shoot one of them.
Witnesses who are mostly Irungu's friends told investigators at Kayole DCI offices that the detective brandished the gun several times during their drinking spree that took them to three different joints on the fateful night.
Ndunda, a boda boda rider, was arrested by police after a tip-off by members of the public and was escorted to his house where the gun was allegedly recovered after a search by cops.
He denied the charges before Chief Magistrate Tito Gesora who amusingly sought to ascertain if there is such a place (Gesora Road) where Irungu was robbed.
Ndunda was released on a bond of Sh500,000 without an option of a cash bail.
The case will be mentioned on October 8, 2024, before the hearing starts on June 24, 2025.
