Health CS Aden Duale and Attorney General Dorcas Oduor face contempt proceedings for allegedly failing to implement a High Court order to appoint elected members of the KNDI Council within the court-directed timeline.

Health Cabinet Secretary Aden Duale and Attorney General Dorcas Oduor are facing contempt of court proceedings over allegations of failing to implement a High Court order requiring the appointment of elected officials to the Kenya Nutritionists and Dietitians Institute (KNDI) Council.
The application, filed at the High Court by Oscar Kambona, claims the two State officials disregarded a judgment delivered on March 25, 2026, in Judicial Review Application No. E014 of 2026, which directed the Health Cabinet Secretary to gazette and appoint the duly elected council members within 14 days of being served with the decision.
Court documents indicate that the judgment was served on both the Cabinet Secretary and the Attorney General on March 30 through physical and electronic means. According to the applicant, the compliance deadline expired on April 13 without any action being taken.
Kambona further states that even after his lawyers issued a demand letter on April 17 calling for immediate compliance with the court’s orders, the respondents allegedly failed to act.
"The respondents have deliberately and wilfully disobeyed the orders of this Honourable Court despite being fully aware of the judgment and the obligations imposed upon them," the application states.
He argues that the continued non-compliance undermines the authority of the judiciary and denies the elected KNDI council members the opportunity to assume office.
"The respondents' conduct is a direct affront to the dignity and authority of the court and continues to prejudice the applicant, the interested parties and the public at large," the court papers further state.
Kambona is asking the High Court to find both Duale and Oduor guilty of contempt of court and impose appropriate sanctions, including fines or any other coercive measures the court may deem fit.
He is also seeking orders compelling the Health Cabinet Secretary to immediately gazette and formally appoint the elected members of the KNDI Council in compliance with the March 25 judgment.
The matter was mentioned before Justice William Musyoka, who directed the respondents to file and serve their responses within seven days before the application proceeds to hearing.
