Two former NYS officials jailed for defrauding agency Sh791 million

They were found guilty of conspiracy to defraud after colluding to loot the agency in payment for fictitious procurement.

A Milimani court has jailed two former National Youth Service (NYS) bosses after they were found guilty of defrauding the state agency of Sh791 million in 2015.

Hendrick Nyongesa Pilisi and Samuel Wechenje were sentenced to serve jail terms of seven and five years, respectively, without the option of a fine.

They were found guilty of conspiracy to defraud after colluding to loot the agency in payment for fictitious procurement.

Pilisi was found guilty of making a false document contrary to Section 347(a) as read together with Section 349 of the Penal Code, as well as breach of trust by a person employed in public service contrary to Section 127(1) as read together with Section 127(2) of the Penal Code.

"Jointly with others not before court, with intent to defraud, made a false document, namely a Ministry of Public Works supplies branch circular, purporting it to be a genuine document issued by the said Ministry," the charges against Pilisi read.

On the other hand, Wechenje, who was a finance director, was convicted of breach of trust under the same provisions.

Pilisi and Wechenje colluded with others by processing payments that led to the loss of the money at the agency between December 1, 2014 and June 5, 2015.

Pilisi was jailed for seven years for making a false document and five years for breach of trust.

The sentences delivered by Chief Magistrate Wandia Nyamu run concurrently meaning the convict will serve the longest jail term.

Wachenje was condemned to serve five years for breach of trust. None was given an option of a fine.

The two became the first employees of the agency to be convicted and jailed for the scandals that rocked the first term of former president Uhuru Kenyatta’s administration.
