Court defers plea in Sh5bn Starehe Boys Centre land fraud case over accused’s ill health

According to the court documents, the two are expected to plead to four counts of obtaining registration by false pretences, forgery and presenting forged documents.
A Nairobi court has postponed the plea hearing of two men accused of conspiring to defraud Starehe Boys Centre of a land parcel worth Sh5 billion.
Milimani Principal Magistrate Geoffrey Onsarigo allowed the application by a lawyer representing the accused persons, Geoffrey Gichuhi Gatu and Kanguru Edward Githinji, to have the plea deferred.

In court, the lawyer said Githinji, a 70-year-old man, developed health complications before the plea was taken.
When he was called for the charges to be read, he was unable to stand by himself, and his lawyer responded, urging the court to consider his situation and defer pleading.
He assured the court that the duo would present themselves in court since they had been complying all through during investigations.
The magistrate released them on a personal bond of Sh10 million with three contact persons each and scheduled the matter for mention on June 16, 2025, for pleading.
According to the court documents, the two are expected to plead to four counts of obtaining registration by false pretences, forgery and presenting forged documents.
They are accused of attempting to defraud Starehe Boys Centre of their land parcel LR No 1870/III/553/IR No 94224 measuring 2.156 hectares located in Westland, Nairobi.
They are also accused of forging the certificate of title for part of the said parcel of land, purporting it to be a genuine certificate issued by the Ministry of Lands.
On the third count, they are accused of forging a stamp impression of CK Ngetich, a land registrar, which appeared on the alleged forged title deeds.
They will appear in court on June 16, 2025, to face the charges.
