High Court gives government 14 days to respond to fuel pricing challenge

The High Court has directed the government and other parties named in a petition challenging Kenya's fuel pricing framework to file their responses within 14 days.

Petitioner Francis Awino told the court that the dispute extends beyond recent adjustments in pump prices and centres on the legality of the process used to determine fuel costs.
"The reduction of fuel prices does not resolve the constitutional questions raised in this petition. The issue before the court concerns the procedure and legality of the decisions that affect millions of Kenyans," Awino submitted.
Awino argued that withdrawing the case simply because fuel prices had been lowered would leave critical constitutional concerns unanswered.

In the petition, the activist seeks to stop the implementation of fuel prices announced by the Energy and Petroleum Regulatory Authority (EPRA) for the period running from May 15 to June 14, 2026.
He contends that the pricing decisions were arrived at without sufficient transparency and public participation, contrary to constitutional requirements.
According to court documents, Awino claims that the fuel pricing mechanism has a direct impact on the cost of living and therefore demands meaningful engagement with the public before such decisions are made.
"The burden imposed by fuel prices is felt across the economy, affecting households, businesses and transport costs. Such decisions should not be made without adequate public involvement," he argues in the petition.
The court ordered all respondents to file and serve their responses within two weeks. The matter will be mentioned on July 2, 2026, for further directions on the hearing of the case.
