The High Court has found Health CS Aden Duale in contempt over failure to comply with orders relating to an Ebola quarantine facility in Laikipia County.

Cabinet Secretary for Health Aden Duale has been found in contempt of court for failing to comply with High Court orders relating to the establishment and management of an Ebola quarantine facility in Laikipia County.
In a ruling delivered on Monday, the court said Duale had deliberately ignored its directives, concluding that his actions amounted to wilful disobedience of court orders.
"The second respondent has failed to comply with the orders of this court and is therefore in contempt," the court ruled.
Following the decision, the judge ordered the Health CS to appear in person before the court on June 23, 2026, for mitigation ahead of sentencing.
Katiba Institute filed the contempt case through advocate Malidzo Nyawa, who accused the respondents of deliberately disregarding court directives on the Ebola quarantine facility.

During the proceedings, the petitioner argued that despite clear court orders, the respondents had taken no meaningful steps to comply, thereby undermining the authority of the judiciary and the rule of law.
The court agreed with the submissions, finding that the second respondent’s conduct demonstrated a deliberate failure to obey lawful court orders.
"The conduct of the second respondent amounts to contempt of court and warrants appropriate sanctions," the judge stated.
The ruling marks a significant development in the dispute over the Ebola quarantine facility, with the court stressing that public officials are bound by court orders regardless of their positions.
Legal observers say the decision underscores the judiciary’s willingness to hold senior government officials personally accountable for non-compliance with court directives.
Duale is expected to appear before the court for mitigation, where he will be allowed to explain his actions before sentencing is determined.
The court will reconvene on June 23, 2026, for mitigation and sentencing directions.
