CS Duale reiterated that the government respects the rule of law and will abide by the High Court directive stopping the facility pending the determination of a petition challenging its implementation.

Health Cabinet Secretary (CS) Aden Duale has declared that the government will comply with a court order temporarily halting the establishment of a US‑backed Ebola quarantine facility at Laikipia Air Base in Nanyuki.
Duale, however, warned that emergency measures under the Public Health Act could be invoked if an Ebola case is confirmed in the country.
He reiterated that the government respects the rule of law and will abide by the High Court directive stopping the facility pending the determination of a petition challenging its implementation.
The CS stressed that such facilities are a critical part of national emergency preparedness.
“Let me be clear, preparedness facilities are not evidence of an outbreak. They are just a precautionary measure to ensure that should there be a confirmed case, our health systems can respond effectively while protecting the population,” said Duale.
He added that the 50‑bed facility is part of a broader network of 23 preparedness units aimed at strengthening the country’s capacity to respond to infectious disease outbreaks, particularly in light of rising Ebola cases in neighbouring countries.
“The Laikipia facility is part of the 23 facilities, and we are a government that respects the rule of law, so we abide by the court decision. But in the event we need to invoke the Public Health Act, Sections 35 and 36, we will invoke the Public Health Act. An epidemic of this manner should not wait for more consultation. We have to save lives. We have to prepare the country,” he said.
Ebola cases in the Democratic Republic of Congo (DRC) have risen to 676, with 136 deaths reported, while Uganda has also recorded a spread of the virus. Kenya has not confirmed any cases but has intensified surveillance, screening and preparedness measures at borders and airports.
Meanwhile, the High Court has certified as urgent an application seeking to have Duale and Attorney General (AG) Dorcas Oduor cited for contempt over the planned facility, in a petition challenging the project.
The matter is ongoing before the court.
