The High Court has temporarily barred Innocent Odhiambo Muganda from assuming office as Chairperson of the Political Parties Disputes Tribunal (PPDT) after granting leave for judicial review proceedings challenging his appointment.
In ex parte proceedings, the court ruled that the leave granted would operate as a stay, effectively stopping Muganda from taking up the position or performing any duties as the tribunal's chairperson until the case is heard and determined.
"The leave granted herein shall operate as a stay of the appointment of Innocent Odhiambo Muganda as the Chairperson of the Political Parties Disputes Tribunal pending the hearing and determination of the substantive judicial review application," the court ruled.
In its decision, the court observed that documents filed by the applicant showed that Muganda had already been appointed, his appointment published in the Kenya Gazette and that he had been sworn into office. However, the judge said the legality of the appointment would only be determined after hearing the substantive judicial review application.
The court also noted that Muganda's appointment was gazetted on June 26, while the challenge against the appointment was filed three days later, on June 29. Since the application for leave was not opposed by any of the respondents, the court allowed the ex parte Chamber Summons.
"The prayer seeking declaratory orders shall be considered during the hearing of the substantive judicial review application," the judge stated.
The applicant has now been directed to file and serve the substantive judicial review motion within seven days.
As part of the interim orders, the court further directed that Muganda shall not assume office as PPDT Chairperson or execute any contracts or official duties attached to the office pending the outcome of the case.
The matter will be mentioned on July 15, 2026, for compliance, further directions and consideration of the substantive judicial review proceedings.
The orders mean that the leadership of the Political Parties Disputes Tribunal will remain unchanged until the High Court determines whether the process leading to Muganda's appointment complied with the law.
