Makueni Senator Daniel Manzo claimed that he had been informed that the body suspected to be Mutumwa's was found together with another suspected to be of Mwau who was also reportedly abducted in December last year.
Both families are at the morgue for the start of the scientific process of identifying the bodies through DNA to ascertain whether they are identical to their relatives.
The families were at Milimani law courts to follow up on the case where the Law Society of Kenya has sued the National Police Service (NPS) together with Inspector General of Police Douglas Kanja, Director of Criminal Investigations (DCI) Mohamed Amin, Director General of the National Intelligence Service (NIS).
Others sued include the Cabinet Secretary for the Ministry of Interior, the National Transport and Safety Authority and the Director of Public Prosecutions.
Kanja and Amin absolved the NPS from the abductions.
The IG said Mutumwa and Mwau were reported missing at the Athi River police station on December 21, 2024, vide Occurrence Book (OB) number 23/21/12/2024 and the same has been under investigation as a case of missing persons.
Denied involvement
Kanja categorically stated that none of the abducted men was in the custody of the police.
"We have none of the subjects. We have none. I want the people of Kenya to know that they are safe. We have come from the festive season and all these people here enjoyed the season and have come out," stated Kanja after taking to the witness box.
Both Kanja and Amin said investigations are being done by the deputy director of the investigations bureau at the DCI headquarters Assistant Inspector General (AIG) Paul Wachira.
The two said that Wachira is in a better position to update the court on the status of the investigations.
When he took to the stand, Wachira told the court that he took over investigations into the cases of Nzyuko and Mwau and that of Kalali Muema who was reported missing at the Mlolongo police station on December 26, 2024.
The detective said the disappearance of Kalali was reported by Susan Muema who told the police that Kalali had been missing since December 12, 2024. He remains missing.
Wachira said the DCI has opened two inquiry files – Inquiry file number 33/2024 at the Athi River DCI offices in regards to Mutumwa and Mwau's disappearance and another detailed 2/2025 at the Mlolongo DCI offices about Kalali's disappearance.
He said DCI investigations have so far established that Mutumwa and Mwau were riding on a motorcycle from Athi River to Kitui on a business trip when they disappeared.
"We have encountered certain challenges of witnesses not willing to provide information willingly and that is why we have to follow legal procedures," stated AIG Wachira.
Wachira said some of the information DCI is seeking includes call logs and information in connection to financial transactions which is protected by the Data Protection Act (DTA) and legal procedures have to be followed in obtaining such information.
