Court of Appeal judges set to elect new president to succeed Justice Daniel Musinga

Four judges are set to compete in a secret ballot overseen by the IEBC to succeed Justice Daniel Musinga as President of the Court of Appeal following the end of his non-renewable five-year term.

Court of Appeal judges are set to elect a new President of the Court of Appeal on Monday, June 22, 2026, through a secret ballot overseen by the Independent Electoral and Boundaries Commission (IEBC).
In a statement, the Judiciary said the election follows the expiry of the non-renewable five-year term of the outgoing President of the Court of Appeal, Justice Daniel Musinga, which ended on May 24, 2026.
Four judges have been cleared to vie for the position: Justice Gatembu Kairu, Justice Patrick Kiage, Lady Justice Agnes Murgor and Lady Justice Lydia Achode.
"Judges of Appeal are set to elect the President of the Court of Appeal tomorrow, Monday, 22nd June 2026. This follows the expiry of the term of the former President of the Court of Appeal, Justice Daniel Musinga," the Judiciary said on X.
"Election will be by secret ballot and will be overseen by the IEBC," it added.

The four candidates are among the Court of Appeal's most experienced judges, having presided over landmark decisions that have shaped Kenya's legal landscape.
According to a notice issued by IEBC Returning Officer Martin Wachira Nyaga, all four candidates were validly nominated under Rule 5.5 of the Court of Appeal Election Rules, 2013, following the close of the nomination process.
The election will be held between 10:00 a.m. and 1:00 p.m. at the Sarova Stanley Hotel in Nairobi, with voting conducted by secret ballot.
The IEBC has also confirmed that judges unable to attend in person will be allowed to vote electronically, provided they notify the Commission at least two days before the election, in accordance with Rule 7.9 of the Court of Appeal Election Rules, 2013.
Justice Wanjiru Karanja is currently serving as Acting President of the Court of Appeal after taking over when Justice Musinga's term came to an end.
The election will determine Justice Musinga's successor as head of the appellate court.
