A Kahawa Law Court has convicted a man on multiple terrorism-related charges after the prosecution proved he was a member of the outlawed Al-Shabaab group and possessed extremist propaganda linked to terrorist activities.
Principal Magistrate Gideon Kiage found Ibrahim Hussein Hassan guilty on seven counts under the Prevention of Terrorism Act, 2012, including membership in a terrorist organisation, collection of information connected with terrorism, and possession of articles intended for use in the commission of terrorist acts.
The court heard that Hassan was arrested on September 6, 2022, in Eastleigh Section III, Nairobi, and was established to be a member of Al-Shabaab, which was outlawed in Kenya through Gazette Notice No. 2326 of April 7, 2015.

In delivering the judgment, Magistrate Kiage held that the prosecution had proved its case beyond reasonable doubt, relying heavily on forensic evidence retrieved from the accused's mobile phone.
"Having established that the Samsung phone belonged to the accused and that its analysis yielded three videos containing radical extremist terrorist propaganda, and in the absence of any reasonable explanation for their possession, this court draws the inference that the accused associated with or was a member of a terrorist group," ruled Magistrate Kiage.
The court found that the videos contained radical extremist propaganda capable of recruiting, training and radicalising young people into terrorism.

Besides the count of membership in a terrorist organisation, Hassan was also convicted on three counts of collecting information connected with terrorism contrary to Section 29 of the Prevention of Terrorism Act, 2012, and three counts of possessing articles linked to the commission of terrorist acts.
The prosecution, led by Principal Prosecution Counsel Kennedy Amwayi with the assistance of Prosecution Counsel Fatuma Ahmed, presented evidence from ten witnesses during the trial.
Following the conviction, the court directed that Hassan return on July 29, 2026, for mitigation before sentencing.
