Rongai MP hopeful seeks Sh50 million damages over alleged FGM remarks

According to the letter, the politician allegedly stated in the Kalenjin dialect that Chelel was unfit to contest the Rongai parliamentary seat unless she underwent female genital mutilation (FGM).

Rongai parliamentary aspirant Mercy Chebet Chelel has threatened to sue a rival politician, demanding a public apology and Sh50 million in damages over remarks she claims were defamatory, discriminatory, and aimed at damaging her political career.

Through a demand letter issued by Danstan Omari & Associates Advocates, Chelel accuses the politician of making offensive statements during a public fundraising event in Menengai West Ward, Nakuru County, on May 24, 2026.

According to the letter, the politician allegedly stated in the Kalenjin dialect that Chelel was unfit to contest the Rongai parliamentary seat unless she underwent female genital mutilation (FGM).

The lawyers argue that the remarks portrayed Chelel as incapable of leadership and undeserving of public office based on her alleged circumcision status, thereby injuring her reputation and standing among voters.

Chelel contends that the comments formed part of a broader campaign to frustrate her political ambitions within Rongai Constituency.

The demand letter further alleges that Chelel was harassed during a funeral attended in Rongai Constituency on May 26, where individuals allegedly linked to the politician disrupted proceedings and subjected her to intimidation.

Her advocates claim the conduct amounted to a coordinated effort to undermine her political activities and influence within the constituency.

The lawyers argue that the alleged remarks promote harmful cultural practices and violate constitutional guarantees on equality, human dignity, and freedom from discrimination.

Citing Article 2(4) of the Constitution, they maintain that any custom or cultural practice that conflicts with constitutional values is invalid and unenforceable.

"The promotion or endorsement of practices that demean women and undermine their equal participation in leadership is unconstitutional and unacceptable in a democratic society," the advocates state in the letter.

Chelel is seeking an unconditional admission that the remarks were made, a public apology within seven days, and compensation of Sh50 million for the alleged damage to her reputation and political prospects.

Her lawyers have warned that court proceedings will be instituted if the demands are not met within the stipulated period.
