The High Court has been asked to issue orders barring Tourism and Wildlife Cabinet Secretary Rebecca Miano from allegedly taking part in partisan political campaigns while serving as a State officer.
In a constitutional petition filed by Francis Awino, the court is urged to restrain Miano from participating in political rallies, mobilisation activities, or endorsing candidates in her capacity as Cabinet Secretary, on the grounds that such conduct is inconsistent with the constitutional standards governing public officers.
The petitioner also wants the court to prohibit Miano from using government vehicles, security personnel, public facilities, State officers or any other public resources to support political activities until the case is heard and determined.

Awino further seeks orders directing the Ministry of Tourism and Wildlife and other relevant government agencies to preserve records relevant to the case, including travel schedules, expenditure reports, security deployment records, communication logs, and vehicle movement records connected to Miano's alleged involvement in the Ol Kalou parliamentary by-election campaigns.
He is also asking the court to compel the Ethics and Anti-Corruption Commission (EACC) to investigate the allegations and submit a preliminary report within 30 days.
In addition, the petition seeks disclosure of Miano's official travel records, government expenditure and logistical arrangements relating to her visits to Ol Kalou during the campaign period.

According to the petition, the dispute raises significant constitutional questions touching on leadership and integrity, accountability of State officers, electoral fairness and the alleged misuse of public resources.
"Continued participation by serving Cabinet Secretaries in partisan political campaigns undermines public confidence in the neutrality of government institutions," Awino states in court documents.
The petitioner further argues that the Constitution requires State officers to remain politically neutral while discharging their official duties.
However, the application did not secure urgent certification. Justice Lilian Mutende declined to certify the matter as urgent and instead directed the petitioner to serve all respondents and interested parties, who have been granted 14 days to file their responses.
The case will be mentioned before the Presiding Judge at the Ol Kalou High Court on August 3, 2026, for further directions.
